Shop Terms and Conditions

1. The Karczma Rzym online shop, accessible at karczmarzym.com.pl, is operated by JFJ SP. z o.o., ul. Bydgoska 1, 86-014 Pawłówek, a company entered in the National Court Register. Maintained by the District Court in Bydgoszcz, 13th Commercial Division of the National Court Register, under number: 0000911756

Share capital – 5,000 PLN

2. These terms and conditions are intended for Consumers and set out the rules and procedures for concluding a distance selling contract with a Consumer via the Shop.

3. „The customer may pay for the goods ordered via the external imoje payment system, operated by ING Bank Śląski S.A., with its registered office in Katowice.”.

4. Information on all costs of goods and services, including delivery costs:

(a) collection in person – free of charge

b) electronic delivery in the form of an e-voucher – free of charge

c) delivery costing 10 zł via DPD courier

5. There are no restrictions on the sale of the product range on offer.

6. You do not need to create an Account to browse the Shop’s product range. Customers may place orders for Products available in the Shop’s range by providing the necessary personal and address details required to fulfil the Order, without creating an Account.

INFORMATION IN THE RULES AND REGULATIONS:

Terms and Conditions – Right of Withdrawal

1.1 The right of a trader making purchases for purposes related to their business, but which are not of a professional nature for the purchaser, to withdraw from the contract within 14 days. 2. The complaints procedure in force at your shop (which should take into account the rights of a business making purchases for purposes related to its business activities, but which are not of a professional nature for the buyer).

Since January 2021, business owners who make purchases for purposes related to their business but which are not of a professional nature for the purchaser have acquired consumer rights regarding withdrawal from a contract and making complaints.

For example, traders who make purchases for purposes related to their business but which are not of a professional nature for the purchaser are entitled to withdraw from the contract within 14 days / to lodge a complaint.

1.2 The Buyer is entitled to withdraw from the contract in writing without giving any reason within fourteen days of the date on which the contract was concluded, pursuant to the Act of 30 May 2014. (Journal of Laws 2014, item 827, as amended). In the event of a written withdrawal from the contract, the Customer is obliged to return the goods within fourteen days. The right referred to above also applies to a natural person entering into a contract directly related to their business activity, where it is apparent from the content of that contract that it is not of a professional nature for that person, as evidenced, in particular, by the nature of their business activity, as disclosed under the provisions on the Central Register and Information on Economic Activity.

2. If the buyer exercises their right to withdraw from the contract within 14 days, they shall bear the cost of returning the goods.

3. Information on the complaints procedure.

  • The Sales Agreement covers new Services.
  • Complaints must be submitted in writing by email to the Seller’s addresses specified in these Terms and Conditions.
  • Goods returned as part of the complaints procedure should be sent to the address given in the company details.
  • Goods sold in the Shop are covered by the manufacturer’s warranty
  • Complaints may be lodged by both consumers and natural persons entering into a contract directly related to their business activities, where it is clear from the terms of that contract that it is not of a professional nature for those persons, arising in particular from the nature of their business activity, as recorded in accordance with the provisions on the Central Register and Information on Business Activity
  • Out-of-court methods of handling complaints and pursuing claims
  • Detailed information regarding the Consumer’s options for using out-of-court complaint-handling and redress procedures, as well as the rules governing access to these procedures, is available at the offices and on the websites of district (municipal) consumer ombudsmen and civil society organisations, whose statutory remit includes consumer protection, the Provincial Inspectorates of Trade Inspection, and at the following web addresses of the Office of Competition and Consumer Protection: https://www.uokik.gov.pl/spory_konsumenckie.php; https://www.uokik.gov.pl/sprawy_indywidualne.php

  • The consumer has the following examples of ways in which they can make use of this
    on out-of-court methods of handling complaints and pursuing claims:
  • A consumer is entitled to apply to the permanent consumer arbitration court referred to in Article 37 of the Act of 15 December 2000 on the Trade Inspection (Journal of Laws of 2014, item 148, as amended), with a request to resolve a dispute arising from the Contract concluded with the Seller.
  • A consumer is entitled to apply to the provincial inspector of the Trade Inspection Authority, in accordance with Article 36 of the Act of 15 December 2000 on the Trade Inspection Authority (Journal of Laws of 2014, item 148, as amended), with a request to initiate mediation proceedings for the amicable resolution of a dispute between the Consumer and the Seller.
  • A consumer may obtain free assistance in resolving a dispute between themselves and the Seller, and may also seek free assistance from the district (municipal) consumer ombudsman or a civil society organisation whose statutory remit includes consumer protection (including, amongst others, the Consumers’ Federation and the Association of Polish Consumers).

AS PART OF OUR PRIVACY POLICY:

1. The controller of your personal data is: JFJ Sp. z o.o. If you have any queries regarding your personal data, you can contact us via the email address or telephone number provided in section 7, ‘INFORMATION ON THE SHOP’S WEBSITE’.

2. The Controller collects and processes, via the Website and other means of communication, the Users’ personal data listed below, which is provided during the registration process on the Website: first name and surname, residential address, email address, telephone number, etc.

3. Purpose: „The processing of your personal data enables us to provide services including, amongst other things, the fulfilment of orders and communication relating to the performance of the contract. Duration: „Personal data will be retained for the duration of the contract and for a period in accordance with applicable legislation, taking into account the limitation periods for claims and tax obligations. Personal data for which you have given your consent to processing will be retained until you withdraw your consent.”.

4. „The user has the right at any time to access and amend their personal data, as well as to request that the Controller delete it without delay („the right to be forgotten”).”

6. „You have the right to lodge a complaint with the supervisory authority responsible for the protection of personal data, namely the President of the Personal Data Protection Office.”
